1. Ordering
    • By placing an order, the customer acknowledges and accepts Lusufalia’s Terms & Conditions. Payment is considered as confirmation of the customer’s approval to proceed with the work, including the artwork produced.
    • Placing an order without payment does not imply that production has commenced. As such, any deadlines may be at risk if payment is not made promptly.
    • Customers are advised to provide a required delivery date (deadline) prior to payment to allow ample time for production.
  2. Sizing & Quantities
    • Sizing requirements and quantities must be specified promptly at the time of order. Failure to do so may result in the missed deadline.
  3. Pantone References
    • All orders must have Pantone references provided for artwork purposes. If Pantone references are not supplied, Lusufalia may assign alternative Pantones, but will not be responsible for any inaccuracies in relation to the customer’s brand or design.
  4. Artwork Approval & Pantone Accuracy
    • Failure to supply vector-quality artwork, Pantone references, or approval of the sample or visual may result in a failure to meet the agreed deadline.
  5. Sampling
    • Lusufalia provides a pre-production sample for approval for every order. Samples will be chargeable at the price agreed upon at the time of ordering, and payment must be made in advance.
    • If a pre-production sample is not possible or is not requested by the customer, photographic approval may be provided. However, as image quality may vary depending on camera and screen, Lusufalia cannot accept responsibility for any discrepancies in Pantone references or designs approved via photographic approval.
  6. Visuals
    • Garment visuals prepared by Lusufalia are not to scale and may vary when transferred to the garment.
  7. Colour Consistency
    • While Pantone reproduction ensures accurate colour dyeing, slight variations may occur in separate print runs. Lusufalia will not be held responsible for colour variations from previous orders or within large bulk print runs.
  8. Intellectual Property
    • Original artwork and designs created by Lusufalia remain the intellectual property of the company, unless otherwise agreed in writing. Any unauthorised reproduction of designs, including sharing artwork with other custom clothing suppliers, constitutes a copyright infringement and theft of intellectual property.
  9. Production Times
    • Sampling requires a minimum of one week from receipt of payment and design approval. Production takes a minimum of three weeks from sample approval confirmation received via email.
  10. Prices and VAT
    • All prices are subject to VAT at the prevailing rate at the time of ordering.
  11. Delivery
    • Deliveries will be made to the address specified on the order form, unless otherwise agreed in writing.
  12. Shipping
    • Lusufalia uses a domestic courier for deliveries within the UK, with an estimated delivery time of between one and three days from dispatch.
  13. Third-Party Shipping
    • Lusufalia accepts no liability for costs, delays, or damages incurred by third-party couriers or international shipping services, including customs handling.
  14. Force Majeure
    • Lusufalia will not be held responsible for delays or failures in delivery, or for damages or defects caused by events or circumstances outside of its control.
  15. Order Tolerance
    • Lusufalia operates on a 5% order tolerance, and the contract will be considered fulfilled if the total delivered quantity is within this tolerance.
  16. Complaints
    • Any complaints regarding delivered products must be submitted to Lusufalia within five days of delivery.
    • Complaints concerning delivery, non-delivery, damaged goods, faulty goods, or any other issues must be submitted within four days of the scheduled delivery date.
  17. Returns
    • Returns will not be accepted for customised items, except in cases where items are found to be faulty due to manufacturing defects or significant issues with print quality.
  18. Cancellation Policy
    • A cancellation fee may apply for any work carried out on an order that is cancelled before production or delivery. Orders cancelled after a Purchase Order (PO) Number has been issued will incur a 50% cancellation fee.
